Commercial Real Estate for Sale in Dubai: A Buyer's Guide

Commercial real estate for sale in Dubai covers offices, retail shops, showrooms, warehouses, whole buildings and plots, and almost every one of them is sold through the same Dubai Land Department (DLD) transfer system as an apartment. What changes is the arithmetic and the paperwork: a commercial sale carries 5% VAT on top of the DLD fees, the unit has to suit the activity on your trade licence, and many units come with a tenant already in place. Below are the decisions in the order a buyer meets them.

What kinds of commercial real estate are for sale in Dubai?

The stock splits into five groups: office units and full floors, retail shops and showrooms, warehouses and light-industrial units, whole buildings, and commercial or mixed-use land. Most buyers start with a strata unit: one office or shop in a jointly owned building, with its own title deed and a share of the service charge. Whole buildings and plots need building-level checks.

Our complete guide to commercial property in Dubai covers the shop-versus-office and rent-versus-buy questions in more depth.

Can foreigners buy commercial property for sale in Dubai, and where?

Yes, non-UAE nationals can buy commercial property in the areas designated for foreign ownership. Regulation No. 3 of 2006, issued under Law No. 7 of 2006 on real property registration, lists the areas where non-UAE nationals may hold freehold ownership without a time limit, or usufruct and leasehold rights of up to 99 years. Later resolutions have added land to those areas.

In practice, the question is not your nationality but the title of the specific unit. Ask for the title deed or the Oqood registration and confirm that it is freehold, not a leasehold or usufruct interest, before you compare it with other listings. In a free zone, also check the authority's rules on who may occupy the unit.

Should you buy for your own business or as an investment?

Buy for your own business when the location, layout and permitted use fit your licence for several years; buy as an investment when the rent and the tenant are strong enough to carry the price. The same unit can be a good buy for one and a poor buy for the other.

For an investment, work from net income after service charges, vacancy and fees. No official source publishes a current commercial yield, so we quote none (no data).

Ready, tenanted or off-plan: which listing fits your plan?

A ready vacant unit suits an owner-occupier, a tenanted unit suits an investor who wants income from day one, and off-plan suits a buyer who can wait and pay in stages.

• Ready vacant: confirm the title deed, the service-charge position and that the fit-out or shell condition matches the listing.

• Tenanted: read the lease, the Ejari registration, the rent and the expiry date before you agree a price.

• Off-plan: pay only into the project's escrow account. Law No. 8 of 2007 requires developers to receive buyers' payments for off-plan units into an escrow account for that project, and the sale is registered with DLD as an Oqood record.

If a developer asks for a booking amount before the sale agreement, read our guide to the expression of interest (EOI) and whether it is refundable.

Where are commercial units for sale in Dubai concentrated?

Commercial supply clusters where business districts and dense residential communities meet. Office towers are concentrated in established business districts such as Business Bay, while shops and small offices in mixed-use buildings appear across communities such as JVC, JVT, Al Jaddaf, Motor City, Majan and Arjan, where they serve the residents around them. Warehouses sit in industrial and logistics zones rather than in residential areas.

Location decides the tenant pool: a ground-floor shop lives on residents' daily needs, an office on access and parking. Confirm the planned activity is allowed in the building before you shortlist it.

How do you check that a listing is genuine before you pay anything?

Check four things before any deposit: the advert's DLD permit, the broker's licence, the title record and the seller's identity. Property adverts in Dubai need an advertising permit issued through DLD, and the permit number should appear on the listing. The broker and the brokerage should both be registered; our guide on how to verify a Dubai real estate broker licence shows the official channels.

Then match the title deed (or Oqood) to the seller, ask whether the unit is mortgaged, and never send a deposit to a personal account.

What does it cost to buy commercial property in Dubai?

The official costs are the DLD transfer fee, trustee centre fees, small administrative fees and, on a commercial unit, 5% VAT on the price. DLD lists the transfer fee as 2% of the sale value from the seller and 2% from the buyer, a total of 4%; in the market the sale agreement often moves the full 4% to the buyer, so read that clause before you sign.

How does VAT change the numbers on a commercial purchase?

VAT adds 5% to the price of a commercial unit, which is the main cost difference from residential property. The UAE Ministry of Finance states that supplies, including sales and leases, of commercial property are taxable at the standard rate, while residential supplies are generally exempt, with the first supply of a new residential building within three years of completion zero-rated.

Ask whether the price is quoted plus VAT. If a VAT-registered business will use the unit, ask your tax adviser whether the input VAT is recoverable.

Can you finance commercial real estate for sale in Dubai?

Yes, banks in the UAE lend against commercial property, but terms are set by each bank and differ from residential mortgages. There is no official published loan-to-value cap for commercial property that we could verify, so treat any percentage you hear as a bank-specific offer, not a rule (no data).

The official cost is fixed: DLD charges 0.25% of the mortgage value to register the mortgage. If the seller still has a loan, settle the bank-release sequence in the sale agreement.

What are the steps from offer to title deed?

The route is offer, sale agreement, developer no-objection certificate, transfer at a trustee centre, and a new title deed in your name. In order:

• Agree the price, VAT treatment and who pays which fee, then sign the sale agreement; our guide on what to check in an SPA lists the clauses.

• The seller obtains the developer's no-objection e-certificate (e-NOC) in freehold areas, through the Dubai REST app.

• Both parties attend a Real Estate Registration Trustee centre, or use the digital channel, with Emirates IDs or, for non-resident foreigners, passports.

• Fees are paid, the transfer is registered and DLD issues the new title deed.

Our trustee office transfer day checklist covers what to bring on the day.

What should you check on a commercial unit that already has a tenant?

Check that the income is real, registered and long enough to justify the price: the lease, Ejari, proof of rent received, expiry and renewal terms, and who holds the security deposit.

Compare the asking price with recorded deals in the same building rather than with other adverts. Our guide on how to read DLD transactions shows where to look.

Frequently asked questions

Do I need a trade licence to buy a commercial unit in Dubai?

The DLD sale registration asks for identity documents, not a trade licence, so an individual can buy as an investor. You need a licence that permits your activity at that address only when you, or a tenant, will trade from the unit.

Is VAT charged on the trustee centre fee?

Yes. DLD lists the trustee fee plus VAT. The 5% VAT on the price of a commercial unit is a separate charge.

Can a company buy commercial property in Dubai?

Companies do buy commercial property, but eligibility depends on the company's registration and the area. Confirm the documents with DLD first.

Is commercial property in Dubai sold freehold?

In the designated areas under Regulation No. 3 of 2006, non-UAE nationals can hold freehold ownership without a time limit. Some plots carry only usufruct or leasehold rights of up to 99 years, so confirm the title type on the deed.

How long does the transfer take at a trustee centre?

DLD lists a service time of about 25 minutes for the registration itself once documents are complete.
