Guaranteed Rental Return in Dubai: The Contract Checks an Investor Must Make

A rental return is not guaranteed because a brochure uses the word. It is guaranteed only to the extent that a named, solvent party has signed an obligation to pay a defined amount, on defined dates, subject to defined deductions, with a workable remedy if it does not. Everything else is marketing.

So underwrite two things separately: the property itself, priced as if no programme existed, and the contractual income promise laid over it.

When does this apply?

This applies when a Dubai property is offered with a guaranteed rental return, an assured income period, a leaseback or a managed rental programme, whether the unit is off-plan, a hotel apartment, a branded residence or a ready apartment sold with an operator attached.

It does not apply to an ordinary tenancy you arrange yourself, where the rent comes from a tenant and is governed by the Dubai rental law, Ejari registration and the RERA rental index rather than by a developer's or operator's promise.

Who actually owes the return?

The developer, the seller, a hotel operator, a management company and a special-purpose vehicle are different legal persons, and only the named contracting party owes the payment. A recognised project brand in the brochure does not make the brand liable.

Identify the full legal entity in the agreement, where it is registered, who signs for it, what it has completed before, and whether the obligation survives a change of operator or manager. Then match that name across the guarantee, the sale and purchase agreement, the management agreement and the payment receipts. Any mismatch, or a layered structure where one company markets and another pays, should go to a qualified adviser before you reserve.

What the percentage is calculated on, and when it starts

A percentage without a denominator is incomplete. Establish whether it is calculated on the purchase price, the price excluding fees, total cash paid, a reduced eligible amount or something else, and whether VAT, furnishing, parking and service charges sit inside or outside that base. Do not compare two projects' headline figures until both use the same base and the same payment frequency.

Then map the start trigger. The guarantee may begin at the sale and purchase agreement, at handover, at completion, at operator opening, at unit acceptance or when furnishing is finished, so a construction delay can postpone the first payment even though the term sounds fixed. Write a timeline from reservation to first payment covering construction, handover, snagging, furnishing, licensing and operator mobilisation, and ask in writing what extension or compensation applies if the trigger slips.

Every deduction and owner obligation

Some agreements quote a gross figure while the owner still carries the running costs. Build a line-by-line responsibility schedule, and treat anything not clearly allocated as unresolved.

  • Service and community charges, which RERA approves annually for each project and which are charged on unit area. Look up the approved figure for that building and year on the DLD Service Charge Index through Mollak or the Dubai REST app rather than accepting an estimate. The owner stays liable even if the occupant does not pay, and arrears block the developer no-objection certificate and therefore the resale.
  • District cooling or chiller charges, utilities and the DEWA connection deposit, commonly cited as AED 2,000 for an apartment and AED 4,000 for a villa; confirm the current figure with DEWA.
  • Management or operator fees. For an annual letting these are commonly around 5% of annual rent, and short-term or holiday-home management is commonly 15% to 25% of revenue; both are market practice, not fixed rates.
  • Insurance, repairs, preventive maintenance, and furniture and equipment replacement reserves.
  • Licensing and letting costs: Ejari registration for a tenanted unit, approximately AED 220, or a Department of Economy and Tourism holiday-home permit where the unit is operated short-term.
  • Owner-use nights, blackout periods and any charge attached to them.

Default, termination and what security really exists

Read what happens if the payer misses a payment, pays late, becomes insolvent, changes operator or terminates early: notice period, cure period, interest if any, termination rights, enforcement and the dispute forum. A claim you cannot practically enforce is worth less than it reads.

Ask specifically what secures the rental obligation, and ask for the document. A project escrow account is not it. Under Dubai Law No. 8 of 2007, off-plan payments go into a project-specific escrow account with an accredited agent bank, and those funds are dedicated exclusively to that project's construction and are protected from the developer's creditors; the agent retains 5% of the account value after the completion certificate and releases it one year after units are registered in buyers' names. That machinery protects construction money, not a future rental promise. If a bank guarantee or a reserve is claimed, verify it independently with the issuing bank.

Price the property without the guarantee, then model life after it

A guarantee can be funded out of a higher purchase price. Compare the unit against similar unguaranteed properties on location, size, specification, handover date and running costs, using registered transaction and rent data from the Dubai Land Department and DXB Interact, and estimate the premium you are paying for the income arrangement. Then check whether the payments, after deductions and timing, actually recover that premium.

The final guaranteed payment is not the end of the investment. Model open-market rent, vacancy, management, maintenance and resale for the years afterwards, and ask whether an ordinary tenant can use the unit or whether it is tied to an operator, a furnishing package or a licensing model. Remember that a future buyer may not credit the remaining guarantee at all. If the economics only work while the programme runs, the arrangement is delaying the risk, not removing it.

Verify the advertisement and the project on official records

Every Dubai property listing must carry a Trakheesi permit number and a Madmoun QR code, mandatory since April 2023. Scan the code and compare the authorised details with the offer in front of you. Check the broker's RERA registration number on Dubai REST.

For an off-plan unit, use the Dubai Land Department project status service or Dubai REST to confirm the registered developer name, the RERA project number, the completion percentage and the escrow account details, and check that Oqood registration is provided for. For a ready unit, verify the title deed through the "Verification of Certificate of Title" service using the deed number, year and property type, confirm the seller matches the deed and check for a registered mortgage. Verification is one layer of due diligence; it does not replace independent legal review of the contract.

Frequently asked questions

Is a guaranteed return risk-free?

No. It replaces occupancy risk with counterparty risk. Payment depends on the contract, the payer's solvency, the conditions, the deductions and whether enforcement is practical, so it should be assessed as a credit risk sitting on top of a property risk. It is not comparable to a bank deposit, and the Dubai Land Department's transaction records cannot validate one company's private promise.

Does the advertised percentage equal my net income?

Not necessarily. Confirm the calculation base and every owner-paid cost. Where service charges, cooling, utilities, insurance, maintenance, furniture replacement, management fees and licensing remain with the owner, the advertised figure is a gross number and the amount reaching your account will be lower. Recalculate the payments yourself from the written formula and the contractual calendar.

What happens if handover is delayed?

Check the start trigger and what the contract says about delay; do not assume payments begin on the date in the marketing. Off-plan sale and purchase agreements commonly allow the developer a grace period of six to twelve months beyond the anticipated completion date, which is developer-specific and must be read in your own contract, and a delayed trigger can shorten the effective income period.

Is the guarantee secured by escrow or a bank?

Not automatically. A project escrow account under Dubai Law No. 8 of 2007 exists to fund that project's construction, and it is a different obligation from a rental promise. If a bank guarantee, retention or reserve is said to support the payments, ask for the document and verify it with the issuing institution rather than relying on a brochure line or a verbal assurance.

Can I sell during the guarantee period?

That depends on the transfer, termination and assignment clauses, and on whether a buyer inherits the programme or it falls away. Before handover, an off-plan resale also needs the developer's no-objection certificate and an Oqood transfer, and developers commonly require a minimum percentage of the price to have been paid first. Confirm both routes before you commit.

Which clauses need independent legal review?

The payer's obligation, the calculation base, deductions, the payment trigger, default and cure, security, owner-use limits, termination, transfer and assignment, the dispute forum, and how the guarantee interacts with the sale and purchase agreement. Resolve inconsistencies inside signed documents, never through informal messages, and keep enough reserves that you are not depending on the promised income to meet essential obligations.

Bottom line

Treat a guaranteed rental return as two decisions. Would you buy this property, at this price, with no programme attached, judged on registered sales and rents, service charges and demand? And is the income promise written by a party you can identify, priced net of every cost you will actually carry, backed by security you have seen, and enforceable if it is broken? If the first answer is no, the second one cannot rescue it.
