Yes. Freehold ownership is available to non-UAE and non-GCC nationals in Dubai's designated freehold areas under Dubai Law No. 7 of 2006, and the buyer receives a title deed issued in their own name by the Dubai Land Department. In practice, though, the most important step for a foreign buyer is to separate the area story from the legal ownership structure. A location may be well known, but the real legal test is what appears in the sale documents and the title record. If your goal is long-term holding with stronger resale flexibility, freehold is usually the stronger format; if the asset is offered under usufruct or leasehold, the duration and legal scope of that right become central to the decision. Always ask for clear confirmation of the ownership type before booking, especially in remote or cross-border purchases.
This article focuses on the designated-area mechanism and how to confirm a specific property's status. The full picture of foreign purchase across the UAE sits in our main article on whether foreigners can buy property in the UAE.
How does the designated-area mechanism work?
The default position is that property in Dubai is owned by UAE and GCC nationals. Article 4 of Dubai Law No. 7 of 2006 then creates the exception: others may hold freehold, or take usufruct or long lease rights of up to 99 years, in areas determined by the Ruler of Dubai. The right therefore attaches to where the plot sits, not to the buyer's nationality alone. Outside those areas, freehold is not available to non-UAE and non-GCC nationals, however a listing is marketed.
What is the difference between GCC nationals and everyone else?
- UAE and GCC nationals: may own wherever UAE nationals may own, without being limited to designated areas.
- All other nationalities: freehold inside designated areas, or usufruct or long lease of up to 99 years where those are offered.
- Companies: ownership through a company is possible, but DLD accepts specific jurisdictions and structures — onshore or free-zone — with differing conditions. Confirm acceptance before you incorporate anything for this purpose.
Residency is not a condition of buying. You can purchase on a visit entry or entirely remotely through a properly attested power of attorney, and the title deed is issued in the non-resident buyer's own name.
Which areas are designated freehold?
The official list is maintained by the Dubai Land Department and must be checked plot by plot. Well-known examples include Downtown Dubai, Dubai Marina, Business Bay, JVC, JVT, Palm Jumeirah, Dubai Hills Estate, Arjan, the freehold portions of Al Jaddaf, Motor City, Majan, Dubai Creek Harbour, Dubai South and Jumeirah Lake Towers. Do not treat any published list as a substitute for verification: a single area can contain both designated and non-designated plots, and two listings in the same area can carry different ownership types.
How do you verify a property's status before booking?
- Ask for the plot and project number, not just the marketing name of the development.
- Ask for a copy of the title deed on a ready property, or the Oqood certificate on an off-plan unit.
- Verify it through the Dubai REST app or the DLD website by entering the deed number, year and property type — it takes a minute or two.
- Read the type of right recorded: freehold, long lease, usufruct or musataha, with the term and expiry date where the right is time-limited.
- Match the name, area and unit number against the contract, and check for registered mortgages or restrictions.
- Require the contract to state the ownership type explicitly before you sign — never rely on the brochure or the listing.
- Verify the broker and developer licences, the marketing permit and the QR code on the listing through official channels.
- Plot's freehold designation — Where: DLD / Dubai REST; Why it matters: Decides whether freehold is available to you at all
- Type of right registered on the unit — Where: Title deed or Oqood certificate; Why it matters: The area alone is not enough; a unit may be sold on another right
- Term and expiry of the right — Where: Register and contract; Why it matters: Determines what you later sell and what is inherited
- Mortgages and restrictions — Where: DLD verification; Why it matters: Prevents surprises at transfer
- Developer and broker licences — Where: Official verification channels; Why it matters: Protects you from non-compliant offers
What is the alternative if the area is not freehold?
The alternative is a time-limited registered right: long lease of up to 99 years, usufruct of up to 99 years, or musataha of up to 50 years, renewable. All are registrable at DLD. These are genuine, recorded rights, but they are not perpetual ownership: you sell only the remaining term, banks treat them more cautiously, and some lenders require the freeholder's consent plus a remaining term that comfortably exceeds the loan term. If you go this route, ask early about renewal terms, renewal fees, and who actually holds the decision to renew.
How does freehold relate to residency?
Buying does not grant residency automatically; it makes you eligible to apply, and approval rests with the competent authorities. Since April 2026 there is no minimum property value for the two-year property investor visa where there is a sole owner; under joint ownership each owner needs a share of at least AED 400,000, and the property must be in Dubai with a DLD-registered title deed. The ten-year Golden Visa through the property route starts at a value of AED 2,000,000, accepts a mortgaged property with a bank NOC under current practice, and allows multiple properties to be combined to reach the threshold. Rules and fees change, so verify on the official channels before deciding.
When this applies and when it does not
The general rule — designated areas allow foreign freehold — is correct but not sufficient on its own in three situations. First, where an area is mixed, containing both designated and non-designated plots. Second, where the landowner chooses to sell usufruct or long lease rights rather than full ownership inside an area that is itself designated. Third, where the property sits in another emirate or a different jurisdiction, in which case different rules apply and Dubai's list is irrelevant. In all three, the decider is the official record for the specific unit, not the name of the area.
Bottom line
Freehold is available to foreigners in Dubai inside the designated areas, and it gives you perpetual, inheritable ownership with a title deed in your own name even as a non-resident. But do not buy an area — buy a registered right: ask for the plot number, verify the record, read the type of right and its term, and have it written into the contract before any payment. The above reflects what was published as of September 2026 and can change; verify with the official source before you commit.

Frequently asked questions
Can a non-resident buy freehold property in Dubai?
Yes. Residency is not required to buy, and a purchase can be completed on a visit entry or entirely remotely through a properly attested power of attorney. The title deed is issued in the non-resident buyer's own name. Note that funds must come from the buyer's own account, and a local bank account is often needed for a ready purchase.
Is freehold available everywhere in Dubai?
No. Freehold for non-UAE and non-GCC nationals exists in the areas determined by the Ruler of Dubai under Law No. 7 of 2006. Even within a single area, plots can differ, and some units are offered on usufruct or long lease instead. Verify the status of the specific plot with the Dubai Land Department before booking.
How do ownership rights differ between GCC nationals and other nationalities?
UAE and GCC nationals may own wherever UAE nationals may own, without being confined to designated areas. Other nationalities hold freehold inside designated areas, or take usufruct or long lease rights of up to 99 years where those are offered. All of these rights are registered with the Dubai Land Department.
How do I confirm a property really is freehold and not usufruct?
Ask for the plot and unit numbers and a copy of the title deed, then verify it on the Dubai REST app using the deed number, year and property type. The register shows the type of right and its term where time-limited. Then require the sale contract to state the ownership type explicitly, rather than relying on marketing material.
Can I own property through a company?
It is possible, but the Dubai Land Department accepts specific structures and jurisdictions, whether onshore or free-zone, and the documentation differs — typically a trade licence, memorandum of association, board resolution and ultimate beneficial owner declaration. Confirm that your intended structure is accepted before incorporating an entity for this purpose.
Does buying freehold give me residency in Dubai?
Buying makes you eligible to apply; it does not grant residency automatically, and approval rests with the competent authorities. Since April 2026 there is no minimum value for the two-year investor visa for a sole owner, and under joint ownership each owner needs a share of at least AED 400,000. The Golden Visa property route starts at AED 2,000,000.
What if the property is offered on a 99-year usufruct?
That is a real, registered right, but it is time-limited: you later sell only what remains, and the property reverts to the freeholder at expiry unless renewed. Before signing, ask about renewal terms, renewal fees and who holds the decision to renew, and ask your bank about financing this type, which varies considerably between lenders.
